This Terms and Conditions of Use Agreement (hereinafter referred to as "Agreement") describe the terms and conditions applicable to your use of Maps of World Videos, which is identified by the Uniform Resource Locator www.videos.mapsofworld.com (hereinafter referred to as "videos.mapsofworld"). This agreement has been entered into between you as the user of videos.mapsofworld (hereinafter referred to as "User") and videos.mapsofworld.

The User agrees to use the services provided by videos.mapsofworld, its affiliates, consultants and contracted companies, for lawful purposes only. User agrees not to violate any laws, third party rights or our policies. The User agrees that he will not alter or modify any part of the website, including but not limited to videos.mapsofworld's embedded player or any of the technologies related to it.
The User agrees that he will not access User submissions or videos.mapsofworld content through any technology or means other than the video playback pages of the videos.mapsofworld website itself, the videos.mapsofworld's embedded player or any other authorized means videos.mapsofworld may designate.
The User agrees that he may submit audio content, video content, pictures or / and textual content on the videos.mapsofworld website. Collectively these content submissions by the user are termed as User submission.
The User shall bear the sole responsibility for his own User submission and consequences of posting and publishing his own User submissions. videos.mapsofworld expressly disclaims any and all liability in connection with User submission. videos.mapsofworld honors intellectual property rights and it will not permit copyright infringing activities and infringement of intellectual property rights on its website. Videos.mapsofworld will remove all contents and User submissions if properly notified following the process prescribed hereinafter and / or if it seems to videos.mapsofworld that such User submission is infringing the intellectual property of the rightful owner. The User agrees that videos.mapsofworld reserves all rights to remove User submissions without prior notice.
The User affirms, represents and warrants in connection with his User submission that - Either he owns or he has necessary license, consent, right and permission to use and authorize videos.mapsofworld to use all copyright, patent, trademark, trade secrets or any other proprietary rights in and to any and all User submissions to enable inclusion and use of the User submissions in the manner contemplated by the website and these terms and conditions of service.
The User also affirms, represents and warrants in connection of his User submission that he has the written permission and / or consent of each and every identifiable individual person in his User submission to use such person's name or likeness for use and inclusion in the videos.mapsofworld service in the manner contemplated in these terms and conditions.
In connection of User submissions, the User hereby agrees that he will not submit any submission which is copyrighted, protected by trade secrets or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless the User is either the owner of such rights or have acquired permission from the rightful owner of such right.
The User agrees not to post any User submission which is false, inaccurate, misleading, defamatory, libelous, unlawful, threatening, harassing, abusive, tortuous, vulgar, pornographic, indecent, invasive of another's privacy, hateful or objectionable on the ground of racial, ethnic, castism or regionalism.
The User agrees not to use services of videos.mapsofworld, if he is not able to form legally binding contracts, is less than 18 years of age or is temporarily or indefinitely suspended from videos.mapsofworld.
The User agrees not to transfer his videos.mapsofworld account and User ID / password to another party without videos.mapsofworld's consent.
If it is found that any User submission does not comply with the provisions of the Clauses 10-16, videos.mapsofworld has the right in its sole discretion to cancel the registration of the User and debar the User from using the Services of videos.mapsofworld, and / or other affiliated websites without prior intimation whatsoever. In addition, the User agrees to bear all civil and criminal liabilities for any such submission.
If a User believes that his work has been copied in way that constitutes infringement of his copyright, or his intellectual property rights are otherwise violated, he must notify videos.mapsofworld at -

If the User believes that his User submission which has been removed or to which access has been disabled, is not infringing, or that the User has the authorization from the copyright owner, the copyright owner's agent, or pursuant to law, to post and use the content in his User submission, he may send a counter notice at the address mentioned herein before in clause 17 containing all the necessary information. After receiving a counter notice, videos.mapsofworld may send a copy of the counter notice to the original complaining party informing that person that videos.mapsofworld may replace the removed submission or content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider - the User, the removed submission or content may be replaced, or access to it restored, in 14 business days or after any other reasonable time which deemed fit, after receipt of the counter notice, at videos.mapsofworld's discretion.
The User, while retaining the ownership of the User submission, grant videos.mapsofworld royalty - free, non - exclusive, worldwide, sub - licensable and transferable rights and licenses to -
1. Host, cache, store, archive, index, crawl, create algorithms based thereon, modify or trans - code the User submissions to appropriate media formats, as part of the videos.mapsofworld service;
2. Use, modify, remix, reproduce, distribute, excerpt, adapt, prepare derivative works of, publicly display and publicly perform the User submission on the videos.mapsofworld service or on any COMPARE property, including in connection with any distribution or syndication arrangement thereof with third parties or third party sites, in any media format or medium and through any media channels and
3. Use User submissions for advertising, promotional or commercial purposes, including without limitation, the right to publicly display, perform, reproduce and distribute User submissions in any media format or medium and through any media channels.
The User, while submitting User submission to videos.mapsofworld, grants the use of and rights to his User submission to other Users, the following rights -
1. the non-exclusive license to access User submissions through the services of videos.mapsofworld.
2. the right to the registered users to rate his User submission.
3. the non-exclusive license to use, reproduce, distribute, remix, prepare derivative works of and compilations, display and perform his User submissions.
The User agrees to provide authentic and true information. Videos.mapsofworld reserves the right to confirm and validate the information and other details provided by the User at any point of time. If upon confirmation such User details are found not to be true (wholly or partly), videos.mapsofworld has the right, in its sole discretion, to reject the registration and debar the User from using the Services of videos.mapsofworld, and / or other affiliated websites without prior intimation whatsoever.
Videos.mapsofworld reserves and has the right to sell, license and / or display any advertising, promotional and distribution rights in connection with User submission and videos.mapsofworld will be entitled to retain any and all revenue generated from any sales or licenses of such advertising, promotional or distributional rights.
Notwithstanding anything contained herein videos.mapsofworld acts merely as an information intermediary and, shall in no way be responsible for any quality, reliability and authenticity of User submissions. Videos.mapsofworld shall in no way responsible to any infringement of intellectual property rights violated by a Use of the website videos.mapsofworld. Further, videos.mapsofworld shall also not be liable for any kind of submissions mentioned expressly in clause 11. In no event shall videos.mapsofworld, its directors, officials, representatives and employees be liable for any of the aforementioned attributes of User submission and the damage such submission caused.
The User agrees to indemnify and hold harmless videos.mapsofworld, and its subsidiaries, affiliates, officers, agents, or other partners, and employees, from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of User's use of and access to the videos.mapsofworld service, violation of the terms and conditions by the User, User's violation of any rights of third person or entity, or User's violation of any applicable laws or regulations.
The User specifically agrees and acknowledges that videos.mapsofworld shall not be liable for any User submissions or any defamatory, offensive or illegal conduct of any third party and that the risk of harm or damage from the forgoing rests entirely on the User.
The User expressly agrees to the disclaimer of videos.mapsofworld.
Any clause contained in this Agreement, if deemed invalid, void or for any reason unenforceable, shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the terms and conditions.
This agreement shall be construed in accordance with the applicable laws of India. The Courts at Delhi shall have exclusive jurisdiction in any disputes arising out or pertaining hereto.
